| [#2750] Szigeti Recently VANGUARD is re-issuing many of Szigeti's controversial late recordings in mid-price. Thanks to whlee, I listened to this set. At first, the old Szigeti's tone really bothered me (like my impression many years ago), but then as the music moves (or struggles) along, I become more and more enthralled. It's difficult to describe my feeling. The playing is definitely not as polished as Grumiaux or Szeryng on their sets, but somehow Szigeti keeps your interest more than usual and each movement takes on different characters, something the relatively homogeneous Grumiaux and Szeryng sometimes fail to do. The playing of Horzowski on the piano is magnificent, fluent and stylish (as always). Two of the sonatas have George Szell as pianist. Szell is excellent but he does not have the humanity of Horzowski. Challenging but rewarding listening  |

In order to hold DJ liable for his defamation (誹謗), a plaintiff should satisfy the following factors and principles to claim DJ the tortuous damages: 1)the statement itself must be defamatory and bring the plaintiff into hatred, contempt or ridicule 2)Reference to the plaintiff: a sufficient indication that the plaintiff is the subject of the comment, an innuendo in statement must be proved and tried by the judge. 3)Publication: defamation only exists if a publication is made to at least one person other than the Plaintiff or the defendant’s spouse. Yet the lever is never prejudiced on one side, DJ can have the following reasons of defence if he will be actually sued 1)Justification or truth: An absolute defence that statement is substantially true though DJ has the onus of proving the truth of his statement 2)Fair Comment: The statement is a fair comment upon a public interest, the test is whether DJ was “an honest man expressing the genuine opinion based upon true facts existing at the time the comment was made” 3)Absolute Privilege (Legco member, statement given by witness…) 4)Qualified Privilege: Statement made for the protection of one’s private interest or for the protection of the public interest, or the statement maker and recipient have a common interest in the matter. Should you need further professional advice, please go to seek a qualified solicitor to take a look whether having a case or not! Think twice before saying that “或會向閣下追究法律責任”, otherwise it’s just a mere bluffing! Regards George |

| [#2756] Sibelius Dr. John, Can you name a few the best CD relating to "The Swan of Tuonela"(圖內拉河上的天鵝 or黃泉的天鵝). I found that this is a big trial for hifi system esp. those sessions with low and deep background accompanied by violin solo. |

My post did not motivate parties to consider proceeding, instead I urge people to think the merit and demerit of suing other for defamation, simply time-wasting, money-wasting and lose-lose for both sides!
