According to my experience, as long as your insurance didn't have to pay anything out, they would not reduce your NCB. I also heard from friends that for your first accident (your fault), they usually reduced your NCB to 3 years (assume you were getting max NCB). I think for comprehensive claims, it may be different. |

I guess it might be a tactic to avoid paying or to squeeze some discount out of their settlements. In Canada, making car insurance claim was a simple matter. Just file a claim, the insurance companies would arbitrate the fault, settle the claims between themselves, and pay to the repair shop directly. If you were at fault, you had to pay for the deduction (called "excess" in HK) or whatever portion you were liable for (in case you were not 100% at fault). Any claim against the other insurance company was handled by your own insurance company. | [#18] 交通意外,警察告佢法官判有罪對方唔認罪~~~~????? 有點唔明. 叫得樓主上庭做證人, 即係件案未審完, 既然未審完, 點解法官會已經判對方司機有罪? (因為佢唔認罪,警方話就算判左,佢都有權上訴,上訴,再上訴,所以要我出庭做証,多D証據,幫助大D)係未審完,所以咪上黎問下係咪甘煩同程序上係點攪.事發在3月,11月中先叫我上庭,跟住佢又上下訴甘呀,真係唔知會唔會一年,一年又一年~~~~~**(再次多謝甘多位解答謝謝. |

| [#14] 交通意外,警察告佢法官判有罪對方唔認罪~~~~????? ＞如果法庭判違例者有罪, 保險公司都係唔會負責架啦, 唔係, 保險公司一定先要賠比受害人, 之後再民市追返個車主, 而如果車主並非酒駕、藥駕之類, 只係一般渣車出錯, 只需要比墊底費, 而保險公司就要賠餘額, 但保險公司亦有權為賠償額而提出由公正行再評估維修價, 一般行到呢步就個數都應該相當大, 唔係一兩萬既事. 如果事主係酒駕、藥駕之類, 保險公司會全數加埋行政費用追返車主, 不過呢ｄ唔關受害人事. |

| [#10] 交通意外,警察告佢法官判有罪對方唔認罪~~~~????? D揸歐洲車嘅車主係咁架，佢哋都係買全保，全程交俾保險公司跟，保險公司都叫車主、司機唔好認，仲會搵公司答辯人上庭代車主、司機答辯及不認罪，但警方提控告對方，一般都會被法裁定「不小心駕駛」。而保險公司不會因入罪而賠償，一味拖字决，逼你要循民事法庭追討，但答辯人都係不承認責任，並要求同你庭外商議和解，將賠償金額減半，只要你有時間不怕浪費時間，可以不用理會，，至小額錢債法庭判被告不當全數賠償，因為對方已被定法庭定罪「不小心駕駛」，到時保險公司一定全數賠償。 |

They should handle the "excess" for you as well. If you still haven't heard from the other insurance company about the refund of the "excess" paid by you a month or so after the court ruled, you should give your insurance agent (or your insurance company rep) a call. In my case, I still hadn't received any refund after almost a year had past since the accident. I had to call my agent before I could get the refund from the other insurance company.
