[#16] complain to BMW & HK SAR on EFV concession Just got off the phone with BMW salesman and according to him, becuase my Luxury Line was the very first batch, therefore, it's made in Germany. The current batch that approval for EFV concession are made in South Africa. Since two separate country's 328i acutally have some difference spec that's consider "Trade Secret" therefore, he is not in the position to disclose them. That pissed me off even more, I think both BMW and EPD have lots of explaining to do! |

[#7] complain to BMW & HK SAR on EFV concession It would interesting to look at the contract from a different perspective. When the contract is signed and a deposit is made, the price of the car was firm and agreed. The price is what BMW will get for selling the car. I think there is no argument. Even if BMW for some reasons has to increase the costs, the contract protects the buyer so BMW will not be able to past on the added cost to the buyer. Likewise, if BMW finds a way to lower costs its has no obligation to share the savings with the buyer. But the tax can be something different. The tax will not be levied at the time of contract, but when the car is first registered upon arrival in Hong Kong. Although paying tax for the car is obligatory for the buyer, BMW is essentially acting as a "agent" of the buyer to collect and pay the tax on the buyer's behalf, in order to smooth out the purchase process (it is in fact a service to the buyer). If we follow this logic, then in this particular case BMW has collected more than is required to pay the first registration tax, which was reduced before the car is first registered and when the tax becomes payable. So, as a matter of principle, BMW has no right to keep that extra money it collects from the customer. Of course, the counter argument is BMW will not be able to sell legally unless it pays tax for its vehicles. This is a different logic and in this case one can argue that the first registration tax is becoming part of the cost of BMW in selling the car in Hong Kong, and so any savings in this cost will not be shared with the buyer. However, if one looks at the quotations by almost all car dealers, the tax is always a separate item which may imply the dealer has no intention to absorb any changes in tax. Despite the above, I think one needs to look at the fine print of the contract terms and conditions. [#5] complain to BMW & HK SAR on EFV concession Oh, just remember that if you signed the contract before the date for the EFV became effective, then your vehicle will not be subject to the deduction. It happened that for some super cars like the Ferrari 458 which has years of delivery lead time, if your contract was signed before 1/4/2011, then you was going to pay the old tax only even if your car was arrived after the tax was increased. |

[#4] complain to BMW & HK SAR on EFV concession I think the date when your BMW was first registered with Transport Department is the key, as I would assume from the Government perspective, if the vehicle is registered after the date when the EFV concession becomes effective, then your vehicle will qualify. I would expect BMW should had informed you on the change in Government EFV assessment and provide you a rebate. But in a business world I won't be surprised if BMW stayed quiet. Imagine if this is the other way round, when the Government announced a increase in tax, then I am sure BMW will ask you for the extra money. You may of course also seek advise from Consumer Council. My 328i landed in HKG 15th May (I did not get EFV Discount) but if you look at EPD website which clearly have PDF file that states 328i met standard set at 1st April 2012!
